1. (contract law) penalty: sum established by a contract to be forfeited in lieu of actual damages in the event of a breach of the contract.

     Section 1438 Engagement does not constitute a cause by which the court may be requested to enforce a marriage. Should [the engaged parties] have made an agreement with each other that a penalty is to be paid in case the engagement contract is breached, such agreement is void.

2. (taxation law) fine imposed on a taxpayer as a penalty for his failure to comply with a tax law or regulation.
